TERMS OF SERVICE — GATO
1. Acceptance of Terms
By accessing or using GATO ("Platform," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you ("User," "you") and Alerta Lab LLC ("GATO," "we," "us," "our").
2. Description of Service
GATO (Gourmet Automatization Transfer Orders) is a SaaS-based inventory management and restaurant operations platform providing:
- Dynamic inventory tracking based on real-time sales data
- Automated reordering from preferred distributors
- Menu and variation management
- Multi-location kitchen management from a single dashboard
- POS system integration and table order management
- Data analytics covering food costs, usage trends, and supplier performance
- Web menu and online reservation capabilities
GATO runs entirely in the browser and requires no special hardware or installation.
3. Account Registration
You agree to: provide accurate and complete information during registration; maintain security of your login credentials; update your account information if it changes; accept responsibility for all activity under your account. Accounts are non-transferable.
4. Free Trial
GATO offers a 30-day free trial for all plans. No payment information is required. Upon expiration, continued access requires a paid plan. GATO reserves the right to modify or terminate free trial offers at any time.
5. Subscription Plans and Payment
- Basic Plan — $29.00/month or $290.00/year: Menu, table, order, and inventory management
- Pro Plan — $59.00/month or $590.00/year: Everything in Basic plus analytics, multi-location, staff management, reservations, and additional features
- Enterprise Plan — Custom pricing: Full feature suite; contact sales
By providing payment information, you authorize GATO to charge your payment method on a recurring basis. Prices may change with 30 days' written notice.
6. Cancellation and Refunds
You may cancel at any time. Access continues through the end of the current billing period. No partial refunds for unused time within a billing period. Annual cancellations are not eligible for pro-rated refunds unless required by law. To cancel: hello@alertacreative.com — Subject: "GATO Cancellation Request."
7. Acceptable Use
You may NOT: use the Platform for illegal or fraudulent purposes; attempt unauthorized access; reverse engineer or decompile the Platform; transmit viruses or malware; scrape data without consent; resell or sublicense access; impersonate any person or entity.
8. Intellectual Property
All Platform content and functionality is the exclusive property of GATO and its licensors. You retain ownership of data you input. You grant GATO a limited license to use your data solely to provide and improve the Service.
9. Data and Privacy
Your use is also governed by our Privacy Policy, incorporated by reference. By using GATO, you consent to data collection and use as described in the Privacy Policy.
10. Service Availability
GATO strives for maximum uptime but does not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.
11. Limitation of Liability
GATO shall not be liable for indirect, incidental, special, consequential, or punitive damages. Total cumulative liability shall not exceed amounts paid in the three (3) months preceding the claim.
12. Disclaimer of Warranties
The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
13. Termination
GATO may suspend or terminate your account for violation of these Terms, fraudulent activity, or conduct harmful to the Platform or other users.
14. Governing Law
These Terms are governed by the laws of the State of Florida. Disputes shall be resolved in Florida state or federal courts.
15. Changes to These Terms
We may update these Terms. Registered users will be notified of material changes via email. Continued use after changes constitutes acceptance.
